These Website Terms of Use ("Terms") govern your access to and use of NationalOneMortgage.com and its pages, content, calculators, forms, application links, portals, and related services (collectively, the "Website"). The Website is operated by National One Mortgage Corp ("National One," "we," "us," or "our").
By accessing or using the Website, you agree to these Terms to the extent permitted by law. If you do not agree, do not use the Website. Certain features, applications, disclosures, consents, or transactions may have additional terms. If those terms conflict with these Terms, the terms specific to that feature or transaction control.
1. Mortgage Licensing and Availability
National One Mortgage Corp is a mortgage company, NMLS 246740. Mortgage products and services are offered only in jurisdictions where we are properly licensed or otherwise authorized. Product availability, eligibility, rates, fees, loan amounts, and terms vary by jurisdiction, property, borrower qualifications, investor requirements, and market conditions. Nothing on the Website is intended to offer or solicit a mortgage product in a jurisdiction where doing so would be unlawful.
2. No Commitment to Lend
Website information is for general informational purposes and is not a commitment to lend, credit approval, Loan Estimate, Closing Disclosure, rate lock, guarantee of terms, or promise that a product is available. A commitment or approval is effective only when issued in a separate written document by an authorized representative and subject to its stated conditions.
Any rate, annual percentage rate, payment, fee, term, loan amount, savings, qualification, or product example is illustrative unless expressly stated otherwise. Actual terms depend on creditworthiness, income and asset verification, debt obligations, property characteristics, appraisal, occupancy, loan-to-value ratio, market conditions, underwriting, investor guidelines, and applicable law. Required disclosures appearing with a specific advertisement control over general Website descriptions.
3. Calculators and Estimates
Calculators and examples are estimates only. Unless expressly stated, they may omit taxes, homeowners insurance, mortgage insurance, flood insurance, assessments, association dues, prepaid items, closing costs, discount points, adjustments, or other amounts. Results may be based on assumptions that do not apply to you. Calculator results are not credit decisions, disclosures, or offers and should not be relied upon as the sole basis for a financial decision.
4. No Professional Advice
Website content is not legal, tax, accounting, investment, financial-planning, real estate, or housing-counseling advice. You should consult qualified professionals regarding your circumstances. Providing Website content does not create an attorney-client, fiduciary, advisory, brokerage, or counseling relationship.
5. Inquiries and Applications
Submitting an inquiry or application does not guarantee contact, approval, funding, a particular product, or a particular rate or term. You agree that information you submit will be accurate and complete to the best of your knowledge and that you have authority to submit it. False, incomplete, or misleading information may delay processing, affect eligibility, or violate law.
A submission may constitute a mortgage application when it includes the information specified by applicable law, regardless of the label placed on the form. Required disclosures and notices are provided through the applicable application and transaction process and are not replaced by these Terms.
6. Electronic Communications and Signatures
If you choose to transact electronically, separate consent may be required before we deliver notices, disclosures, records, or documents electronically. That consent will describe applicable hardware and software requirements, how to obtain paper copies, and how to withdraw consent. These Terms do not waive any right to receive a disclosure in a particular form or at a particular time.
7. Calls Text Messages and Email
Any consent to receive marketing calls, text messages, prerecorded messages, artificial-voice messages, or automated communications must be provided through the separate disclosure presented for that purpose. Agreeing to these Terms does not itself authorize such communications. Consent is not a condition of obtaining credit or purchasing a service. You may revoke consent by any reasonable method, including the method stated in the communication, replying STOP to a text, using an unsubscribe link, calling us at 800-429-4443, or emailing Customer@National1Mortgage.com. Message and data rates may apply, and message frequency varies.
8. Privacy
Our Website Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. Financial and transaction-specific privacy notices may also apply. By using the Website, you acknowledge that you have had an opportunity to review the Website Privacy Policy. Acknowledgment is not consent to a data practice when applicable law requires separate affirmative consent.
9. Acceptable Use
You may use the Website only for lawful purposes. You may not:
- Interfere with the Website, its servers, networks, security features, or another person’s use.
- Attempt to gain unauthorized access to an account, system, database, or restricted area.
- Introduce malware, malicious code, automated attacks, or harmful material.
- Scrape, harvest, copy, index, or extract Website content or personal information through automated means without written authorization, except as permitted by applicable law.
- Impersonate another person, misrepresent your affiliation or identity, or submit information that you do not have authority to submit.
- Use the Website to commit fraud, violate another person’s rights, or engage in unlawful, abusive, or deceptive conduct.
10. Intellectual Property
The Website and its content, including text, graphics, logos, designs, videos, software, code, and compilations, are owned by or licensed to National One and are protected by intellectual-property laws. You may view and print reasonable portions for your personal, noncommercial use. Except as permitted by law, you may not reproduce, modify, publish, distribute, display, create derivative works from, commercially exploit, or remove ownership notices from Website content without prior written permission.
11. User Submissions
If you submit information, documents, comments, reviews, or other material, you represent that you have the right to submit it and that it does not violate law or another person’s rights. You grant us permission to use the submission as reasonably necessary to respond to you, evaluate or administer a transaction, operate the Website, comply with law, or fulfill the purpose for which it was submitted. Personal information is handled as described in our Website Privacy Policy and applicable financial privacy notices.
Do not submit Social Security numbers, passwords, bank-account information, tax documents, identification documents, or other sensitive material through ordinary email or an unapproved form. Use the secure channel we provide.
12. Third Party Links and Services
The Website may contain links to third-party websites, portals, tools, or services. We do not control and are not responsible for their content, privacy practices, security, availability, products, or terms. A link does not by itself imply endorsement, affiliation, approval, or a referral arrangement. Your use of a third-party service is governed by that party’s terms and policies.
13. Website Accuracy and Availability
We attempt to keep Website information accurate and current, but information may become outdated, incomplete, or incorrect. The Website may be interrupted, delayed, suspended, or unavailable. We may correct, update, suspend, or discontinue Website content or functionality without notice, subject to any legal duty or binding written commitment.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT WEBSITE INFORMATION WILL BE COMPLETE, ACCURATE, OR CURRENT. THIS SECTION DOES NOT DISCLAIM A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIONAL ONE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND IT DOES NOT WAIVE ANY NONWAIVABLE RIGHT OR REMEDY UNDER MORTGAGE, CREDIT, PRIVACY, FAIR-LENDING, CONSUMER-PROTECTION, ACCESSIBILITY, ELECTRONIC-TRANSACTION, OR COMMUNICATIONS LAW.
16. Indemnification
To the extent permitted by law, you agree to reimburse National One for reasonable losses, liabilities, and expenses resulting from your unlawful use of the Website, your material violation of these Terms, or content you submit that violates another person’s rights. This section does not require you to reimburse us for our own violation of law, negligence, willful misconduct, or legal duties that cannot be shifted to a consumer.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law or the nonwaivable law of another jurisdiction applies. Subject to any nonwaivable right to proceed elsewhere, a judicial proceeding arising solely from Website use must be brought in a state or federal court located in Riverside County, California. These Terms do not require arbitration, waive a jury trial, waive participation in a class action, or shorten an otherwise applicable limitation period.
18. Severability and No Waiver
If a provision of these Terms is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.
19. Changes to These Terms
We may update these Terms by posting a revised version with a new last-updated date. Changes apply prospectively and do not retroactively alter a completed transaction, an existing written agreement, or a right that cannot lawfully be changed without additional notice or consent.
